1. SPONSOR: BMK Publishing, LLC  (the “Sponsor”), is solely responsible for all aspects of the 2018 FOUR RV Stay Giveaway Sweepstakes (the “Sweepstakes”).

2. ELIGIBILITY: The Sweepstakes is open to legal residents of, and physically located within, the fifty (50) United States, including the District of Columbia (collectively, “Territory”) who, as of June 10, 2018, are at least twenty-one (21) years of age or the age of majority in their respective states/jurisdictions of permanent residence, whichever is greater. Employees of Sponsor, its subsidiary, affiliated or successor companies (individually and collectively, “Entities”), nor members of their households or immediate families are eligible to enter or win.

3. HOW TO ENTER: There is NO PURCHASE NECESSARY to participate.  A purchase does not increase your chances of winning.  You may enter this Sweepstakes by visiting http://www.fourmagazines.com/fourrvstaygiveaway during the entry period, and following the online instructions to complete the required fields on the entry form and submit. After doing so, you are officially entered into the pool of eligible entrants. Limit: Two (2) entries per person /email address via the registration form. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to verify the eligibility of the winner.

4. LIMITATIONS: Entries by any method other than set forth above in Section 3 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Neither the Entities, nor any of their officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for Entries from persons residing, or physically located, outside the Territory; Entries that are altered, delayed, deleted, destroyed, forged, fraudulent, improperly accessed, inaccurate, incomplete, interrupted, irregular in any way, late, lost, misdirected, multiple, non-delivered, stolen, tampered with, unauthorized, unintelligible or otherwise not in compliance with these Official Rules; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider, Website or other connections; telephone or cell phone service availability or accessibility; miscommunications; failed computer, satellite, telephone or cable transmissions, lines or technical failure; jumbled, corrupted, scrambled, delayed or misdirected transmissions; computer hardware or software or text message malfunctions, failures, technical errors or difficulties; unauthorized human intervention; traffic congestion; undeliverable emails resulting from any form of active or passive email filtering; insufficient space in entrant’s email account to receive email from the Sponsor concerning the Sweepstakes; or other errors of any kind, whether due to electronic, human, mechanical, printing, production or technical errors or other causes; even if caused by the negligence of any of the Releasees. Each of such potential Entries will be disqualified and any attempt by a person to use multiple accounts to enter the Sweepstakes more than once per day may result in disqualification at Sponsor’s sole discretion. Sweepstakes is subject to all applicable federal, state, local and municipal laws and regulations, and is void where prohibited by law.

5. WINNER SELECTION  & ODDS:  On June 10, 2018, one potential winner will be selected in a random drawing, from all eligible Entries received during the Entry Period. Drawing will be conducted by the Sponsor.  Sponsor’s decisions are final and binding on all matters related to the Sweepstakes.  Odds of winning depend on the total number of eligible Entries received during the Entry Period. If the Prize is forfeited prior to Sponsor finalizing and paying for all portions of the Prize, and sufficient time exists to select an alternate winner, the Prize may or may not be awarded to an alternate.

1. WINNER NOTIFICATION: Potential winner will be notified by email and through the Sponsor’s Instagram  account available here: https://www.instagram.com/fourmagazines/. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [a] potential winner’s failure to respond to notification within twenty-four (24) hours after transmission of email notification; [b] the return of an email notification as undeliverable after three (3) attempts; [c] the return of any other notice or prize confirmation notification as undeliverable; [d] potential winner’s failure to submit required documents within the allocated time needed to verify his/her eligibility and/or provide Sponsor with satisfactory proof of age, identity and residency; [e] potential winner’s failure to claim a prize; and [f] any other non-compliance with these Official Rules. In the event of prize forfeiture, the Sponsor may, in its sole discretion, award or not award the forfeited prize to an alternate winner. If the Sponsor elects to award the applicable prize to an alternate winner, such alternative winner will be selected by a random drawing from among all remaining eligible entries received throughout the Sweepstakes Period. Only one (1) alternate winner drawing will be held, after which any remaining prizes will remain un-awarded. Potential winners are subject to verification by Sponsor, whose decisions are final and binding in all matters related to the Sweepstakes. As a prerequisite for receiving the Prize, the potential winner will be required to sign and return the following documents to the Sponsor within Forty-Eight (48) hours of notification: (a) an Affidavit of Eligibility; (b) a liability release for the potential winner and each guest.

2. PRIZE: One (1) grand prize winner (the “Prize Winner”) will receive a two (2) consecutive night stay for 2 people in the FOUR Retro RV. Approximate retail value (“ARV”) of prize is $300. Stay must take place during the pre-selected dates set forth by the Sponsor or the prize will be forfeited. No substitution of prize offered, no transfer of any prize to a third party is permitted and prize may not be redeemed for cash value, except by Sponsor, who reserves the right in its sole discretion to substitute prize for a prize of comparable or greater value. If the actual purchase price of a prize is less than the ARV stated herein, Prize Winner will NOT be entitled to a check, cash or other form of payment for the price difference. Transportation to/from Grand Prize Winner’s residence/hotel is not included as part of prize. Prize Winner is solely responsible for all campsite reservation expenses and fees, federal, state, local (including without limitation, security fees, gratuities, luggage fees, meals, air travel, ground transportation, and incidental charges) related to acceptance and uses of the prize not specifically stated herein. A major credit card is required at check-in to cover any incidental charges. Prize Winner’s guest(s) will be required to execute a release of liability prior to stay. Prize Winner and each of their guests must possess valid travel documents (i.e., a valid government-issued photo ID, passport, etc.). Prize Winner and guest(s) are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.  No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Sponsor.  Stay is subject to the terms and conditions set forth in this Sweepstakes.  Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any air carrier(s) or other transportation companies or any other persons providing any of these services to passengers including any results thereof such as changes in services or accommodations necessitated by same.

3. In the event Prize Winner and/or his/her guest engage(s) in behavior during stay that (as determined by Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the stay early, and send that Prize Winner and/or his/her guest home with no further obligations or compensation whatsoever to Prize Winner and/or his/her guest (which may, in Sponsor’s sole discretion, result in Prize Winner’s disqualification from the Sweepstakes and forfeiture of any (and/or all) prize(s).  In the event a Prize Winner or his/her guest engage(s) in behavior during stay that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects that Prize Winner or his/her guest to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Prize Winner or his/her guest as a result of such conduct.

4. RELEASES: BY PARTICIPATING IN THIS SWEEPSTAKES, ENTRANTS AGREE TO THESE OFFICIAL RULES AND FURTHER AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM AWARDING, ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, ENTRY, OR PARTICIPATION IN THIS SWEEPSTAKES OR IN ANY PRIZE RELATED ACTIVITY OR IN ANY PROMOTION RELATED ACTIVITY (IN EACH CASE, INCLUDING BUT NOT LIMITED TO TRAVEL), OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM. Sponsor is not responsible if Sweepstakes cannot take place or if prize cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, weather or acts of terrorism. PUBLICITY: EXCEPT WHERE PROHIBITED BY LAW, PRIZE WINNER GRANTS TO SPONSOR, AND THOSE ACTING PURSUANT TO ITS AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, PRIZE WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, ENTRY, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME THROUGH SOCIAL MEDIA) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. 2. GENERAL: By entering the Sweepstakes, entrant affirms that they have read, understand and accepted these Official Rules. The Sponsor reserves the right to cancel or to modify the Sweepstake if fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity of the Sweepstakes, as determined by Sponsor in its sole discretion. If, for any reason, the Sweepstakes is not capable of running as planned, Sponsor may, in its sole discretion, void any suspect entries and (a) modify the Sweepstakes or suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the prizes at random from among all non-suspect entries received prior to cancellation up to the time of the impairment. The Sponsor is not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of, or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. Sponsor is also not responsible for any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any materials in the Sweepstakes. CAUTION: Any attempt by an entrant to deliberately damage Sweepstakes’ websites or undermine the legitimate operations of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such entrant to the fullest extent permitted by law.

3. DISPUTES: This Sweepstakes is subject solely to the applicable federal, state and local laws of the United States and is not subject to any laws outside of the United States; provided, however, that, except where prohibited, by participating in the Sweepstakes entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved exclusively by final and binding arbitration under the rules of the American Arbitration Association in an arbitration to be held at the AAA regional office nearest the Sponsor where the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; (b) a judgment upon any such arbitration award may be entered in any court having jurisdiction; (c) to the degree any dispute, claim or cause of action arising out of or connected with this Sweepstakes or any prize awarded is not subject to arbitration, then it shall be adjudicated exclusively by the appropriate Federal courts located in Orlando, Florida, U.S.A or the state courts located in Orlando, Florida, U.S.A; (d) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (e) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (f) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, and any and all rights to have damages multiplied or otherwise increased, other than for actual out-of-pocket expenses. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the State of Florida.
